These Terms and Conditions (“Terms”) govern your use of our website at www.amazingexcursiontours.com (the “Website”) and the purchase of excursions, tours, transportation, and related services through our platform. By accessing or using our services, you agree to be bound by these Terms.

Role of Amazing Excursions & Tours Inc.

Amazing Excursions & Tours Inc. acts solely as an intermediary between you (the “Customer”) and the Service Provider (referred to as “Vendor,” “Service Provider,” “Excursion Company”, “Tour Company”, “Tour Guide” or “Transportation Company”). We provide an online booking platform for Customers to purchase services offered by Service Providers, and coordinate activities for customers. Amazing Excursions & Tours Inc. is not responsible for the actions or obligations of the Service Providers or Customers.

Legal Agreement

Your use of this Website is conditional upon your acceptance of these Terms and Conditions. If you do not agree, please refrain from using the Website. By
making a booking, you enter into an agreement with the Service Provider through Amazing Excursions & Tours Inc., not with Amazing Excursions & Tours
Inc. itself. We do not assume responsibility or liability for the acts, inaction, obligations, or omissions of the Service Provider or the Customer. These include safety, delay, cancellation, overbooking, financial default or strike.

Booking and Purchase

1. Eligibility: You must be at least 18 years old to purchase services.
2. Account Creation: An account is required to complete a purchase, and you are responsible for maintaining the confidentiality of your account information.
3. Booking Agreement: The first named person on the reservation agrees on behalf of all participants to:
• Consent to the use of information in accordance with our Privacy Policy.
• Confirm that all participants meet any age restrictions.
• Accept financial responsibility for the booking.
4. Pricing: All prices are displayed in the selected currency and include required taxes, fees, or charges.
5. Acknowledgment: You confirm that you have read and agree to these Terms.
6. Assumption of Risk: By completing your purchase, you accept full responsibility and liability for all associated risks as outlined in these Terms and Conditions.

Payment

1. Payment Methods: We accept various payment methods, including Visa, Mastercard, American Xpress credit cards, debit cards and interact e-transfers where available. Payments are processed securely.
2. Confirmation: You will receive a confirmation email upon successful booking and payment, and it is your responsibility to verify the accuracy of the information.

Cancellations and Refunds

1. Cancellations and Refunds are subject to Service Providers cancellation policy. Amazing Excursions & Tours will accept the following cancellations as per below unless otherwise specified on your ticket.
2. Excursion Cancellations are accepted if 24 hours or more notice is provided before departure for a full refund or exchange.
3. Tour Cancellations follow these guidelines.
• Full refund if canceled with 5 days or more advance notice.
• 50% refund if canceled between 48 hours to 5 days in advance.
• No refund if cancelled with less than 48 hours notice.
4. Service Provider Cancellations: We reserve the right to cancel a tour due to unforeseen circumstances, offering a full refund or rescheduling option.
5. Non-refundable reservations will be clearly marked.

Changes to Bookings

1. Modifications: Any request to modify your booking must be made in writing. We will assist you by Contacting the Service Provider but cannot guarantee changes will be accommodated by them.
2. Modification Fees: Requests for changes may incur additional fees.

Use of Tickets

1. Non-Transferable: Bookings are generally non-transferable and can only be used by the person named on the booking unless otherwise specified.
2. Identification: All participants must present valid identification and booking confirmation. Access may be denied without it.

Participant Responsibilities

Customers are responsible for ensuring they possess all necessary travel documents, health insurance, and vaccinations (if applicable) prior to travelling, booking and participating in the excursion or tour. Adherence to all instructions from the Service Provider is required for safety.

Transportation Departure Times

Transportation departure times will be confirmed by our travel team by text and email at least one day prior to the excursion or tour to the phone number and email provided by the Customer during the booking. 

Customers are responsible for checking their texts and emails for this information, and ensuring they find the bus meeting location in advance and are ready to board the bus at least 15 minutes in advance of the departure time.  If you are new to the area, need more time or have special travel accommodate needs, we recommend you arrive at least 30 minutes prior to departure time, so you don’t feel rushed or miss the departure time.

The bus will depart at the confirmed departure time and will not wait for any travellers who are not present to board. If you have missed the bus, we suggest that you contact our travel team right away. The travel team will do their best to find alternate private travel arrangements for you. Additional costs will be incurred and is the full responsibility of the Customer to pay the additional cost.

Liability and Insurance

1. Liability Disclaimer: Amazing Excursions & Tours Inc. is not liable for any claims, losses, damages, deaths, or injury whether to property, physical or mental, or expenses arising from any actions or inactions, omissions, or neglect of Service Providers or Customers during or after the excursion.
2. Acknowledgment of Risk: Customers accept full responsibility for all risks associated with the excursions, tours, transportation, or related services.
3. The Customer agrees to indemnify and save harmless Amazing Excursions & Tours Inc. and its parent, subsidiaries, and affiliates, against any liability, actions (including legal fees), claims, losses, costs, and damages, which Amazing Excursions & Tours Inc. may incur, sustain or pay arising out of or in connection with the customer’s acts or omissions, in relation to any incident alleged to have occurred in relation to services provided by Service Providers or bookings through Amazing Excursions & Tours Inc.

Travel Insurance

We highly recommend that Customers and participants purchase comprehensive travel, medical and accident insurance. Amazing Excursions & Tours Inc. is not liable for any accidents, losses, deaths, expenses, costs or fees incurred due to insufficient insurance coverage.

Amazing Excursions & Tours Inc. does not engage in the sale, promotion, or endorsement of any specific insurance provider, ensuring an impartial stance
and compliance with legal regulations governing insurance practices.  This approach prevents any conflicts of interest.  

The customer and all participants are fully responsible for keeping informed of any travel advisories or risks and for making informed decisions associated with their travel and booked activities.

Medical and Special Needs

Customers with medical conditions or special needs who require special services or assistance with trips and activities, including accessible rooms and/private transfers, must contact Amazing Excursions & Tours at the time of booking to confirm if the Service Provider is able to accommodate your needs so you can focus on enjoying your excursions, tour, activity or travel. 

If the Service Provider is unable to accommodate your special needs or wheelchair accessibility due to terrain, facility limitations, suitability of excursion or activity, availability of equipment, which will affect your participation, we will inform you upon booking. 

Customers with any special needs or medical conditions must be self-sufficient and accompanied by at least one other customer who assumes full responsibility for their wellbeing at all times.  Customers must also ensure that any medical conditions are approved for activities by a licensed medical doctor.

While we will attempt to accommodate special requests, we will not be held responsible if your requests can’t be fulfilled.

Force Majeure

Amazing Excursions & Tours Inc. is not liable for any failure to fulfill obligations due to unforeseen circumstances, including natural disasters or acts of terrorism.

Use of Services

By using our services, you agree that all information provided is true and accurate, and you will safeguard your account information.

Star Ratings

Star ratings are based on a number of factors, including, but not limited to, opinions regarding bookings through Amazing Excursions & Tours Inc., and also the Service Providers service including location, amenities, and facilities. These ratings are not a representation or promise of any particular Service Provider services but help us in assess customer satisfaction with our booking service, and customer satisfaction with the Service Provider’s services.

Intellectual Property

1. Ownership: All content on our Website is the property of Amazing Excursions & Tours Inc. or its licensors and is protected by intellectual property laws.
2. Use Restrictions: You may not reproduce or modify any content from our Website without prior written consent.

Privacy

The use of our Website and services is governed by our Privacy Policy. Please review it for details on how we collect, use, and protect your personal information.

Promotional Communications

We may send notifications about special offers, promotions, and updates. If you wish to unsubscribe from our mailing list, please contact us in writing at info@amazingexcursiontours.com.

Termination

Amazing Excursions & Tours Inc. reserves the right to terminate or suspend your access to our Website and services without notice for violations of these Terms and Conditions.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta, Canada. Any disputes shall be subject to the exclusive jurisdiction of the
courts in Alberta.

We may update these Terms and Conditions from time to time. The most current version will be posted on our Website with the effective date. Your continued use constitutes acceptance of the revised terms.

Application

These Terms and Conditions apply and are binding upon all customers included in the itinerary and such customer’s family, dependents, estate, heirs, successors and legal personal representatives.
